UK attracts wealthy 'divorce tourists'
London's reputation as 'the divorce capital of the world' was reinforced this week when a £2.85m payout was awarded after a short-lived marriage between two wealthy Russians.
The increasing generosity of divorce settlements awarded by English courts, and the vast number of wealthy foreigners living in London, is certainly good news for lawyers who look set to make a killing. This case alone came with estimated combined legal costs of £2m.
Living the high life
Russian financier Ilya Golubovich, 26, and his fashion stylist wife Elena, 27, lived in a swanky £4m West London house during their 18 months together.
After the relationship broke down there was a 'race to divorce'. She tried to divorce him in the UK in order to nail a 'big money' settlement for herself and their two-year old daughter.
Her husband in a conscious effort to limit the settlement, pushed for the marriage to be formally ended in Russia, where payouts are typically far lower.
Initially Ilya Golubovich won his case, but this week the Court of Appeal said his wife was entitled to a financial settlement in England, where she still lives.
The court took into account that the wife had been living here since 2001, owned a property here and intended to make England her home.
Despite his lawyers insisting that the couple's connection to Britain was 'extraordinarily thin' the Court of Appeal disagreed and awarded Elena a £2.85m lump sum plus cover for her legal costs – estimated at over £1m.
Opening the floodgates
The ruling is significant as it could open the floodgates to wealthy 'divorce tourists' from around the world.
The UK, and in particular London, continues to attract the world's super-rich who enjoy a lavish lifestlye in the capital.
In the case of the Golubovichs, the couple married in Italy in 2007 and lived at a Kensington home owned by Golubovich's mother. They spent £2m in just 18 months despite having no earnings in this country, the court heard.
Justine Johnston, Ilya Golubovich's defence barrister warned the ruling would "open the floodgates to any international man, or more pertinently woman of the world, to say they have a connection to the jurisdiction (England) and bring divorce proceedings here".
"It should not be open to the wife to take advantage of the more relaxed approach to ancillary relief, especially in so-called big money cases, which this undoubtedly is," she added.
Limited assets
Ilya Golubovich's legal team insist his assets only totally £94,000, arguing that the order was based on the assumption that his parents in Russia would pay the difference.
Though clearly the fact that he was able to spend £2m freely over an 18-month period would tend to indicate that he has easy and ready access to large sums.
This would appear to be the view of Lord Justice Thorpe, who in his judgement stated: 'Mr Golubovich is an international entrepreneur, and people with those skills don't expose themselves to accountability in any particular jurisdiction. He had been learning the technique since an infant at his mother's breast.'
The judge insisted the settlement was 'a pragmatic, sensible decision'.
So there you have it gentlemen, the British divorce courts are so anti male and anti father divorcing women from all around the world want their cases handled in the UK.

Spouses not entitled to lottery winnings
Whose turn is it to buy the lottery ticket? A landmark court ruling could send couples competing for that honour.
A High Court judge has ruled that if someone wins the lottery, their spouse has no rights to any of the winnings unless they are invested in a shared asset such as the family home. If the money is put in a bank account, the lucky winner could walk out of a relationship without having to share any of the jackpot.
The ruling was made in the case of a hotel porter who sued his former wife for a share of her £500,000 National Lottery winnings.
The man, who cannot be named, won a partial victory but the judge, Mr Justice Mosty refused to grant him an equal share because lottery winnings were not "matrimonial property".
The couple were living in a council house over a decade ago when the woman picked the winning numbers, having bought a lottery ticket with her own money and without her husband's knowledge.
She bought a £275,000 house in London with the money, and the couple lived there with their two children for about three years. When they split up, her husband moved out of the family home, now estimated to be worth almost £500,000.
If the couple had operated a "syndicate" where both knew that the tickets had been bought, the windfall would be shared equally, Mr Justice Mostyn said.
As this was not the case, the winnings would normally belong entirely to the wife. But because she had spent some of the money on the family home she effectively converted it into matrimonial property, the judge argued. He ruled that her ex-husband should receive a lump sum of £85,000 for the time he had lived there.
Legal experts were somewhat taken aback by the ruling.
Amanda Melton, the head of the family practice at Matthew Arnold & Baldwin, told the Daily Telegraph: "This somewhat bizarre outcome seemingly suggests that individuals should keep any assets acquired from their own endeavour entirely separate and should not use them to benefit their spouse and immediate family.
"It follows recent trends whereby inherited property has been ringfenced in divorce proceedings where it has not been relied upon during the marriage. One must question whether this is encouraging parties to argue over who is financially responsible for the family whilst they are still happily married."

Calgary dad mourns murdered daughter

He barely knew his daughter Clare, having seen her only five times since the divorce.
James Shelswell said he was looking forward to Clare growing older, and the far-off day when he might finally bond with the child he surrendered when she was only four months old.
Instead, Shelswell will fly this week from Calgary to Abbotsford B.C., to attend Clare’s funeral.
On Sunday, Clare was murdered, her throat slashed open after an apparent domestic dispute between her mom and step-dad over how to discipline the kids.
Peter Wilson, 29, is charged with killing his step daughter.
And now, all that’s left for her biological dad is to say goodbye to the stranger who was once his baby girl.
“She didn’t really know me — I’d seen her maybe five time in five years,” said Shelswell.
If his daughter dying in pain and terror at the hands of the man she knew as her dad wasn’t devastating enough, Shelswell has been told he’s not welcome at the funeral.
His ex-wife, Sarah Wilson, called Wednesday morning to discuss Clare’s murder.
It didn’t go well, and the old resentments resurfaced.
“I didn’t have too much nice to say to her,” said Shelswell.
“I asked if she was in the room when it happened and why she didn’t protect Clare — she said it happened in a different room, and I asked if my other daughter saw it. She said no.”
His ex, said Shelswell, then made it clear he is not welcome at Clare’s private funeral service.
“She said I shouldn’t go to the funeral, and I have no rights to my kids,” said Shelswell.
Taking a deep breath, Shelswell sounds like a man struggling to remain calm.
“Of course I’m going, I’ll be there this weekend, even though she won’t even tell me what time it’s at,” he said.
“I’ll find out.”
Shelswell’s anger is palpable, and he is clearly a man who feels his daughter’s cruel slaying is the culmination of years of injustice.
Clare Shelswell’s life ended Sunday while on vacation with her family in Washington State.
U.S. cops say Peter Wilson, charged with first degree murder, has confessed to his step-daughter’s killing.
A court affidavit states that Wilson told detectives, “as soon as he started to walk down the stairs to the kitchen with Clare he knew he was going to kill her.”
In Mason County court on Monday, statements were read saying Sarah Wilson had admitted to arguing with the suspect over discipline earlier in the day, and her husband told her “he would take care of it.”
The man, who the court heard has bipolar disorder, then walked away.
Soon after, Sarah Wilson heard a scream, and when she rushed to see what was wrong, she found Clare lying on her back in a pool of blood, holding her throat with her hands.
“My husband took a knife to her throat,” Sarah told an operator, in a frantic 911 call.
“She’s barely breathing, she’s barely breathing.”
Nothing could save the little girl.
On Wednesday night, residents of Hoodsport, Wash. planned a memorial for Clare. Her funeral is expected to take place in Abbotsford this weekend.
In Calgary, Shelswell, who is re-married with two kids, is a man whose fury is mixed with remorse.
He laments that he didn’t have enough money to fight back with a lawyer, back when his wife took their Calgary-born daughters away to B.C.
He says he settled into a pattern of paying child support, and looking forward to yearly visit with his girls — the last, a happy trip to Vancouver, included the aquarium and McDonald’s.
That was also the last time Shelswell saw the man now accused of taking Clare’s life.
“I met him a couple times, like when I’d go to pick up the kids, and he seemed normal to me, no one mentioned he was on meds and was bipolar, or anything,” said Shelswell.
“I had no idea.”
Now, too late to save the daughter he never really knew, Shelswell hopes the justice system in Washington State, where the death penalty is practised, make her killer pay.
“He’s got dual citizenship, so I hope they keep him down there and fry his ass,” said Shelswell.
